Terms of Service

These Terms govern the use of outclimbed.com - the public wall, the listing pages, checkout and everything around them. By using the site, listing a climb or completing a payment, you agree to these Terms and to the Privacy notice. If you do not agree, do not pay for a place on the wall.
Who you are dealing with
outclimbed.com is operated by Nitramix Ltd., a company registered in Bulgaria, 208499938 ("we", "us"). In these Terms "you" means the person or company listing a climb.

These Terms work together with the public Rules, which describe how points and rank work and form part of this agreement. Where the Rules and these Terms conflict, these Terms control.
What the service is
outclimbed is a paid public leaderboard. You pay to list a website or an X profile and to hold a position that follows from your points, as described in the Rules. Listings are paid placements. They are not reviews, not editorial picks, not certifications, and not an independent ranking of quality.
There are three things you can pay us for, and they are all advertising:
- Entry - $10 or more, which puts a climb on the wall with 10 permanent base points plus one permanent point per dollar above the minimum.
- Top-ups - $1 for each additional permanent point on a climb you already own.
- Ad slots - a paid placement in the strip above the wall, described below.
A payment buys points, or a placement, and the position that supports at that moment. It does not buy traffic, clicks, customers, revenue, a fixed rank, a rank for any length of time, search-engine ranking, or any other outcome. Anyone can buy more points than you and rank above you, and earned points expire on the schedule in the Rules, so a rank you hold today is not a rank you own.
We may change, pause or discontinue any part of the service, including categories, ad slots and the scoring formula. Points you have already bought keep the value they were sold with.
Who may use it
- You must be at least 18 and able to enter into a binding contract.
- If you list on behalf of a company, you confirm you may bind that company, and "you" includes it.
- You may not use the service if sanctions or the law of Bulgaria, the European Union or another applicable jurisdiction prohibit it.
Payments, Dodo Payments and tax
Checkout is handled by Dodo Payments as merchant of record. Dodo Payments is the seller of record for the transaction, charges and remits any tax that applies, issues your receipt, and its own terms and refund handling apply to the payment itself. We never see or store card details. Prices are in US dollars, and tax may be added at checkout.
Prices are set by us on the server and shown to you before you pay: $10 minimum entry, which includes the 10 permanent base points, and $1 for each additional permanent bought point. Ad slots are priced on the page where they are sold. Completing checkout is your offer to buy on those terms; the points are yours once the payment is confirmed and written to the wall.
Payments are final
Payments are not refundable. A place on the wall is a digital service that is delivered the moment payment is confirmed: the climb appears, the points are credited, and the amount is reflected publicly. By completing checkout you ask us to begin immediately and you acknowledge that, to the extent the law permits that waiver, you give up any statutory right of withdrawal or cooling-off period once delivery has begun. Where a consumer right cannot be waived, we honour it.
None of the following creates a refund:
- Being outranked by someone who paid more, or losing rank as earned points expire.
- Fewer clicks or visitors than you hoped for.
- Removing your own climb - the points go with it, including the bought ones.
- Downtime, or a removal because you broke these Terms.
One exception, because it is ours and not yours: if we remove or hide your climb at our own discretion while you are in compliance with these Terms, we refund what you paid for the points that were lost.
Opening a chargeback or payment dispute without a legal basis is a breach of these Terms. We may remove the climb, keep the removal permanent, and refuse you future use of the service. Talk to us first at support@outclimbed.com - most disputes are a misunderstanding of how points expire, and that is faster to fix in an email.
What you may list
You may only list a website or X profile that you own or are authorised to represent, and the destination must be reachable, must be what your listing says it is, and must make clear who is behind it to the extent the law that applies to that site requires it.
Not allowed, in addition to anything the Rules prohibit:
- Chat and invite links (Telegram, WhatsApp, Discord, Signal, Messenger) and link shorteners or redirect chains that hide the real destination.
- Adult or sexual material.
- Malware, phishing, scams, or anything whose purpose is to deceive the visitor.
- Counterfeit goods, pirated content, or anything infringing someone's copyright, trademark or other rights.
- Offers that need a licence you do not hold, including financial, medical, gambling and weapons-related offers.
- Content that is illegal, fraudulent, defamatory, harassing, hateful, violent, or that exploits children.
- Impersonating a person, brand or company, or listing a competitor's site or handle without their authorisation.
Earning points honestly
Earned points are paid out for real people. Sending bot traffic, scripting visits, opening your own share link through proxies, paying for fake signups, or any other attempt to inflate visitors, clicks or referred signups voids the points it produced and can cost you the climb, with no refund of anything you had bought.
You also may not interfere with the service itself: no scraping beyond ordinary browsing, no rebuilding the wall as a competing product from our data, no bypassing rate limits, no automated listing or purchasing without our written permission, and no reverse engineering except where mandatory law allows it.
Links, and what a place on the wall is not
Every listing links straight at its own site. A listing that has not bought the dofollow upgrade carries rel="nofollow", so it passes no search ranking signal; the upgrade removes that and is disclosed as paid. Either way, a high position means someone paid and promoted. It is not us vouching for them.
Click counts, visitor counts and social proof describe what our systems recorded. They are not a forecast of what you will get. Destinations we link to are not ours; their terms and their behaviour are their own responsibility.
Ad slots
The strip above the wall is advertising space, sold separately from rank. It holds 10 ads at once and it is a queue ordered by recency, not by price: paying puts you at the front, everyone already there moves down one, and once the queue is full the ad at the back drops out.
Prices start at $150 while a slot is still free. Once all 10 are taken you are paying to push somebody out, and the price steps up by $100. There is no ceiling on where that ends: the more the strip is fought over, the more a place in it costs, and neither we nor you can say in advance how high it goes.
The price that applies is the one shown to you at checkout, and it is the only one you owe. It is not a subscription and it does not renew - a placement is bought once, and buying again later is a new purchase at whatever the price is then. We may change these prices at any time; a change never affects a placement you have already paid for.
What you buy is a place in that queue. You are not buying a particular position in the strip, a guaranteed number of impressions, a guaranteed length of time, or the right to stay once ten other people have paid after you. Being pushed out of the strip is the product working as described and is not a refund event. Ads on screen rotate, so the placement is shared, and an ad slot needs an active climb - if the climb is removed or hidden, the slot ends with it.
Ad placements are marked as paid on the page. We may refuse an ad, end an placement that breaks these Terms, and change or withdraw the strip entirely; where we end a compliant placement early for our own reasons, we refund it pro rata.
Our right to remove a climb
We may refuse, delay, edit, recategorise, hide or permanently remove any listing or ad slot, with or without notice, where we believe these Terms, the Rules or the law may have been broken, where a rights holder or platform complains, where the destination becomes unreachable or changes into something else, or where the listing creates legal, security or reputational risk. Removal for a breach does not entitle you to a refund.
Names, logos and the licence you give us
To run the wall we fetch and display public information about a destination: its name, @handle, title, tagline, favicon and profile image. We use that material only to identify the listed product or profile and to show visitors where a paid position leads. Under EU and Bulgarian law we use third-party names and signs solely to identify the goods, services or account being listed; that is not affiliation with, or endorsement by, the rights holder unless the person listing is the rights holder.
You grant us a worldwide, non-exclusive, royalty-free licence to host, cache, resize, format and publicly display your listing and that public metadata for as long as is needed to operate and promote the service and to keep a record of it. If you want a listing taken down, remove it from your profile or email support@outclimbed.com. A takedown does not undo a completed payment.
outclimbed, its name and the look of the site are ours. Do not copy the service, scrape the wall to build a competing ranking, or use our name in a way that suggests we endorse you. Dodo Payments, Supabase, Vercel, Resend, X and other third-party names belong to their owners.
Complaints and rights notices
If you believe a listing infringes your copyright, trademark or other rights, or that a destination is unlawful, email support@outclimbed.com with: your name and contact details; the listing on outclimbed.com; the destination URL or @handle; what the problem is; and a statement that the notice is accurate and that you are the rights holder or authorised to act for them.
We may restrict or remove the listing while we look at it, and we may pass the notice to the person who listed it. Notices that are repeatedly abusive or plainly unfounded may be ignored.
Availability, and changes to these Terms
The service is provided as it is. It may be unavailable, slow, or wrong. We may change the Rules, prices, categories or these Terms; if a change is material we update the date at the top of this page, and continuing to use the site means you accept it. For a payment already made, the Terms in force at checkout keep applying to that payment, unless a change is required by law or needed to deal with a security or legal risk.
Disclaimers and liability
To the fullest extent the law allows, we exclude all implied warranties, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the service will be uninterrupted or error-free, or that listings, names, images, ranks or counts are accurate or complete.
Nothing here limits liability that cannot be limited by law - including intent, gross negligence, injury to life, body or health, and mandatory product-liability or consumer rules. Subject to that:
- We are not liable for lost profit, lost data, lost goodwill, substitute services, or other indirect or consequential loss.
- For slight negligence we are liable only for breach of a duty essential to this agreement, and only for typical, foreseeable damage.
- Our total liability for any claim connected to a payment is limited to what you paid us for the listing that the claim concerns in the three months before it.
You will indemnify us against claims, damages and reasonable legal costs arising from your listing, your destination, your payment or chargeback, your breach of these Terms, or your infringement of someone else's rights.
Law, and the rest
These Terms are governed by the law of the Republic of Bulgaria, excluding its conflict-of-law rules. If you are a consumer, mandatory protections in your own country of residence still apply to you. If you are not a consumer, the courts at our registered seat in Bulgaria have exclusive jurisdiction so far as the law allows.
- If part of these Terms is unenforceable, the rest stands and the invalid part is replaced by the closest valid one.
- Not enforcing something once is not a waiver of it. You may not transfer this agreement without our consent; we may transfer it with the service.
- These Terms, the Rules, the Privacy notice and what you confirm at checkout are the whole agreement.
- Payments, hosting, email and analytics involve third parties. Their outages and their decisions are outside our control.
